At a glance

What it covers
Pays for injuries and property damage you cause to others in an accident with your truck. It’s the coverage your operating authority depends on: at least $750,000 for most for-hire interstate carriers, and $1 million to $5 million for hazardous materials.
Who needs it
Every motor carrier and owner-operator running under their own authority.

What is Covered, What is Not

Primary liability coverage is relatively narrow in scope.  It covers damage done to other people and their property by you while you are driving.  It does not cover you or your rig (you need collision for this; see “physical damage” article).  It does not cover theft or vandalism or a tree falling on your rig (you need comprehensive for this; see “physical damage” article).  It does not cover your cargo (see “cargo insurance” article). Again, it covers damage done to other people and their property by you while you are driving, and nothing else.

Primary trucker’s liability insurance is mandatory under the law in all 50 states; never drive without it.

How Much Coverage

As a general rule, $1 million is considered the minimum coverage, and for certain types of cargo this is a mandatory minimum.  The FMSCA (Federal Motor Carrier Safety Administration) sets some minimums; other minimums are set by load brokers. For hazmat cargo, $5 million is generally the minimum.  In some cases you might want greater coverage; see “umbrella/excess” article.

Questions about primary liability

Don’t see your question? Call us at (888) 353-2953

Is primary liability insurance required for truckers?

Yes. For-hire motor carriers running under their own authority must carry it, and the FMCSA sets the minimums: $750,000 for general freight in interstate commerce, $1 million for oil and some hazardous materials, and $5 million for other hazardous materials. Your insurer files proof of coverage with the FMCSA so your authority can stay active.

Does primary liability cover my own truck or my cargo?

No. It pays for injuries and damage you cause to other people and their property. Your own truck and trailer need physical damage coverage, and the freight you haul needs motor truck cargo insurance.

How much primary liability do I need?

At least the federal minimum for what you haul, but most shippers and brokers ask for $1 million. Your agent sets your limit to match your authority and your contracts.

What affects the price?

Your drivers’ records, your years in business, the radius you run, what you haul, your equipment and the limit you choose. New authorities usually pay more in their first years.

  • Nancy was awesome (I'm sure she still is as well). Quick turn-around, and I was able to reach her when I had questions. The policy itself is another story, but that's the carrier's problem. Axle was great!
